I work for a guy who is an aquaintence of the representative who introduced the bill. we emailed him and this was his response...i`m actually not complaining about it:
"My skeptical workers are all complaining about the new Virginia “bad driver” laws."
Dave Albo`s response: Do your skeptical workers think they should pay more in taxes or that the people who break the laws should pay more. That is what it all comes down to.
As for druming up business, that is totally ludicrous. Tell me if there is one person in the World who would hire me for $1,200 to the un-guaranted possiblitly that I could get them off of a charge that has a $1050 fine.

Sorry you don`t like the bill. In short, the premise of it was that people with good or even normal driving records should not have to pay the same amount as those who break the laws or amass a large number of tickets. I don`t think its fair for you to pay the same as the guy who is driving drunk, reckless or who gets four tickets in one year.
As for your allegation that I am using my office for my personal benefit, please excuse me if I get mad, but I have never used my House of Delegates position to benefit me personally. In fact, I lose tens of thousands of dollars doing this job. Specifically to address your allegation on this Abuser Fee bill somehow benefiting me, quite simply, this is an utterly false allegation. There is not a rational person in the world who would hire me, or any attorney, for $1,200 for an un-guaranteed possibility that they would get out of a $900 or $1050 ticket. I am offended that you would think that I would use my office to advance myself. My take-home pay from the House of Delegates is $900/mo. I don`t do it for the money, I do it because I love the neighborhood in which I grew up and am trying my best to make it a great place to live. Secondly, lawyers have no control over this assessment since it is not a Court charge. If the Court convicts the person, there is nothing a lawyer can do to reduce the Abuser Fee charge. This is because the charge is a DMV charge, not a court charge. It`s just like DMV demerit points. Once a person is convicted, the Courts and lawyers have no power to affect the assessment of points. DMV points cannot be waived by the Court. Likewise, the Courts and Lawyers don`t have any way to affect the Abuser Fee Assessments bill by the DMV.
In my efforts to make our neighborhood a great place to live, I have been listening to my constituents in Springfield and South County. I have been living here since 1970. And everyone has one main complaint - transportation. People have been complaining, asking, begging for years for a solution to the transportation nightmare. One constituent noted that since it takes him 1 1/2 hours to get to work, he can`t be an SYC soccer coach for his kids. Long commutes means that none of us can otherwise have a life outside of work. Three hours a day in a car is a waste of a life, and I intend on solving the problem.
So a number of years ago I started trying to find a way to build some roads. Along with other Delegates from NOVA, we put in bills to pay for NOVA roads with existing revenue. If you look at some of my bills, you will see bills to change the transpo funding formulas, bills to make the rest of VA send us $ for roads, bills to allow NOVA to keep some of the money it sends to Richmond to pay for its own roads. Every year, year after year, the bills were killed. The bottom line is that NOVA has 21 Delegates and the rest of VA has 79. And the 79 refuse to send $10,000,000 of their funds to NOVA.
So, what I wanted to do was not possible.
So what was left? The way I look at it, we could do nothing, whine and cry about it and therefore never build a new road in NOVA, or we could we could solve the problem.
I decided to solve the problem.
Solving the problem required raising a lot of money. I rejected general tax increases proposed by the Senate. I rejected their gas tax, income tax and sales tax increases. I wanted to look at user fees. Activities that generate traffic, and raise money off of those activities.
The story goes on much longer, but to get to the point that you wrote: How did the Abuser Fees come about?
Well one idea was to charge every driver $10-$20/yr to raise $ for roads. Instead, I thought, "Why should good drivers, the drivers who don`t break the laws, pay the same as those who break the laws?" Thus, the Abuser Fee concept was born. We looked at NJ. They have had such a plan in place for years.
Our plan charges about 2% of the drivers in VA. It charges large fees for the commission of traffic crimes (any traffic offense which is punishable by jail time e.g. Reckless, DWI, Driving on a Suspended License, Vehicular Manslaughter, etc.) and those with a large amount of DMV demerit points - any person with a -8. (Note that you can have as good as a +5. And any person who hits a -8 just needs to take a safe driving course on line and get another +5. Thus a -8 is really a -13, which is equivalent of getting 4 moving violations in one year).
So there you are. Sorry you don`t like the idea, but I had to build some roads. If you had a chance to read the Post on Friday, you would have noted all the roads being built in our area. I-95 widening at Newington, the completion of the Fairfax Co Pkwy, widening of Rolling, Light at Rolling and Barnack, new Metro and VRE cars.

You`re chances of getting killed in an accident by a vehicle travelling 75 mph as opposed to 55 is minimal. Its the people that don`t know how to drive that you should be concerned about. If I were habitual speeder, endangered my life everyday because I didn`t know how to control my vehicle.....do you think i`d be risking my life? I`d assume you were probably one of those guys that travels on the left side of the two lane road going 5 mph over the speed limit. You figure that because your vigilante @$$ is already breaking the law, that any adventurous delinquent should pass to the right. The autobahn in Europe harbor recommended speed limits of 70-80mph. Fact of the matter is that the statistics of vehicle accidents are comparable in Europe in comparison to the US. If you`re caught in the passing lane, you`re either an idiot, or you`re about to get mauled over by a Ferrari travelling 60 km/h over the speed limit. So lets make this world a safer place for my kids and yours by educating stupid drivers!

Hey I speed too, and no I`m not crazy about the new laws. But you gotta admit, speeding is against the law.
I guess you`re gonna have to settle down on your speeding.. you sound a little stupid bringing up arguments about 55 vs. 75. (I`m pretty sure you`d rather wreck at 55 than 75, or worse get hit by someone at 55 rather than 75). And as far as the autobahn... well those roads receive about half as much traffic as the US`s national average (which means probably one quarter of NOVA`s average). And as far as you being such a great driver, I`m pretty sure you`re not better than Dale Earnhardt.. you remember him?
Here`s an idea.. try leaving your house earlier. That way you don`t have to speed. The guy`s right, you shouldn`t risk my kids lives because your ass can`t leave the house on time.

I think if you`re going to compare a guy driving into a wall at 200 mph to my comparison of a difference in 20mph, then you`re just as stupid. Where do you think that traffic gets started, through lame ass drivers. Ask anyone that rides a motorcycle and they`ll tell you that its the people driving the vehicles. This same argument can be had if your kid went running out on the street, and in my attempt to avoid him, I crashed into a telephone. So listen dummy, I`ll stop driving my vehicle over the speed limit if you tell your kid to look both ways before crossing the street; practice safe sex; and chew before he swallows. They all have the same consequences....right?

Now I`m glad the law got passed. I can`t wait to see your broke ass driving around in a Hyundai that can`t even go 55 mph. Traffic is started because there is about 4 million people on a road built for 500 thousand. And yes, while there are dumb drivers, it`s probably the dumbass ones that wreck doing 75 that caused the accident in the first place.
By the way, I drive a MC too.. it doesn`t mean anything.

If you are driving 55 on a 55...stay your ass out of the passing lane.
IMO, the reason why speeding would cause traffic is because of tailgaters. People speed up until they can`t speed no more because someone is in front of them. When people tailgate, it doesn`t leave room for someone to change lanes. When you are trying to change lanes and that ass that is tailgating won`t let you in...you have to slow down and try to get in behind him/her. But of course theres someone tailgating him so you have to try and squeeze in behind him/her
